What is Driver Coercion and how does it affect me?
Driver coercion is a new law, that prohibits shippers, consignees, brokers and others from forcing a driver to operate illegally. The rule is designed to protect carriers and drivers from reprisals against them for not doing something that would have violated a safety rule. These include but are not limited to forcing a driver to violate hours of service, forcing a driver to “go” around scales due to overweight issues, forcing a driver to take a shipment they have deemed unsafe, forcing a driver to operate unsafe equipment.
You could be at risk of a Driver Coercion claim if you do the any of the following:
1. Putting specific dates and times for delivery on your bill of lading.
2. Back charging drivers for late deliveries.
3. Threatening drivers to withhold freight or money if they do not take a shipment.
